Conditions of Probation

An evaluation is a screening tool designed to reveal whether or not a person is engaging in harmful or risky behaviors. An evaluation is designed to detect problems early on so that you can receive treatment. These evaluations are completed by a mental health professional that is certified in the specific area of concern. All criminal history and alcohol/drug consumption must be included in the evaluation.

All recommendations in the evaluation must be completed. Evaluation and treatment can not be completed online or over the phone.

Alcohol and Drug Evaluation

The evaluation must be completed by a Certified Addiction Counselor. The following website will allow you to search for a Certified Addiction Counselor in your area.

Georgia's DUI Intervention Program will also provide you with a list of acceptable counselors to complete any treatment that is recommended.

Once you have completed the evaluation, it is important that you have the full evaluation sent to your Probation Officer. Make sure that your name, case number, and the name of your Probation Officer is on the evaluation. It is also important that you get a copy of the evaluation for yourself. You need to read over it and understand the treatment recommendations so you can start them immediately.

Anyone who has been convicted of a DUI must use a counselor from the above website. If your counselor is not listed, you will be told to redo the evaluation. Your treatment must also be completed by one of the listed counselors.

Anger and Violence Evaluation

The evaluation must be completed by a counselor certified in anger and violence counseling. The following website will allow you to search for a counselor in your area.

Deviant Behavior/Psychosexual Evaluation

The evaluation must be completed by a Psychiatrist/Psychologist who specializes in psychosexual assessments. This means an evaluation that focuses on an individual’s sexual development, sexual history, paraphilic interests, sexual adjustment, risk level, and victimology.

Once you have completed the evaluation, it is important that you have the full evaluation sent to your Probation Officer. Make sure that your name, case number, and the name of your Probation Officer is on the evaluation. It is also important that you get a copy of the evaluation for yourself. You need to read over it and understand the treatment recommendations so you can start them immediately.

Contact your insurance company to see if this evaluation could be covered.

Psychological Evaluation

The evaluation must be completed by a Psychiatrist/Psychologist. This evaluation will be an assessment of your overall mental health and development.

Once you have completed the evaluation, it is important that you have the full evaluation sent to your Probation Officer. Make sure that your name, case number, and the name of your Probation Officer is on the evaluation. It is also important that you get a copy of the evaluation for yourself. You need to read over it and understand the treatment recommendations so you can start them immediately.

Family Violence Intervention Program

The Family Violence Intervention Program is a 24 week class. It is once a week and in a group setting. See a list of all of the approved Family Violence Intervention Programs in Georgia. The program that you attend MUST be on this list or you will not receive credit for the class.

Family Violence Intervention Program is not the same as Anger Management.

Inpatient Treatment

If you are ordered by the court or as recommended in your evaluation to enter into an inpatient treatment facility, the inpatient treatment facility must be approved by the Judge or your Probation Officer.

Program Information

Once you enter the program, you are expected to complete the program. Leaving the program before you are properly discharged will result in a revocation of your probation. You are also responsible for supplying your Probation Officer with monthly updates of your progress.

Georgia Association of Recovery Residences will supply you with a list of inpatient facilities that have been approved by the court. It is rare for your Probation Officer to approve an inpatient facility located outside the state of Georgia because of extradition purposes. These will need to be approved by the Judge.

Risk Reduction Program

The Risk Reduction Program consists of 2 parts, (1) the NEEDS Assessment and, (2) a 20-hour course spread out over 3 days.

Program Information

When you complete the program, the instructor will either give you a certificate or email the certificate to you. You will need to keep the original for the Department of Driver Services (if your license was suspended). You will need to make a copy and bring it to your Probation Officer.

You can find a list of Risk Reduction Programs on the Georgia Department of Driver Services website. If you live out of state, this website will also help you find a Risk Reduction Program equivalent in your home state.

All questions regarding the reinstatement of a suspended driver’s license needs to be directed to the Georgia Department of Driver Services.

Defensive Driving

Defensive Driving is a 6 hour class. You will be given a certificate at the completion of the class.

Program Information

You will need to turn in a copy of your certificate to your Probation Officer. You can find a list of Defensive Driving Schools on the Georgia Department of Driver Services website. If you live out of state, this website will give you links and the requirements to help you find the Defensive Driving equivalent in your home state.

Theft and Shoplifting Offenders Program

Theft and Shoplifting Offenders Program is no less than a 3 hour course.

Program Information

Once you have completed the course, you will need to provide a certificate of completion to your Probation Officer. We offer a list of Theft and Shoplifting Offender Programs in the Metro Atlanta area.

This must be done in person. We will not accept any class completed online.

Alcoholics Anonymous/Narcotics Anonymous

If you are court ordered to attend AA or NA meetings, the meetings must be properly documented, using the Verification of Court Mandated Attendance of AA Meetings Form to include the name of the group, date and time of attendance, and must be signed by the chairperson.

Victim Impact Panel

A Victim Impact Panel is to teach about the devastating effects of driving under the influence of alcohol and drugs and to encourage offenders to rethink their future decisions. It is used to educate DUI offenders that the consequences of their actions can be both deadly and emotionally damaging to victims and their family members.

Panel Information

The Judges of Cobb County State Court also order defendants who have been convicted of other alcohol and drug related crimes to attend this panel because of the valuable information that is presented.

MADD originally established this program. Other organizations and counseling facilities have branched off with new Victim Impact Panels. You can go to any Victim Impact Panels as long as it is in person.

The Victim Impact Panel can not be completed online. You will not get credit for an online panel.

Community Service Work

Community service work must be completed with a nonprofit charitable organization that has a 501(c)3 tax exempt status. In order to check an organization to see if it is considered a 501(c)3, you can go to the Georgia Secretary of State website.

Community Service Information

Once you have completed your community service work, you MUST have the organization write you a letter on the organization’s business letterhead. The letter must include the number of hours that you have completed and what you did for the organization. It must also have a signature in ink and a phone number so your Probation Officer can contact them to confirm. You will only receive credit for completing the community service once you have provided the ORIGINAL LETTER to your Probation Officer and it has been confirmed. We will not accept emails, faxes, or copies of this letter.

We will NOT accept a timesheet.

If the organization will not write you a letter, then you will be told to redo the hours.

ONE HOUR CREDIT = ONE HOUR WORKED

Submitting false/forged community service will result in a felony warrant for your arrest.

If you have any further questions about community service, be sure to ask your Probation Officer.

Fine/Restitution/Fee

Payments are to be made to the Cobb County State Court Clerk’s Office on the 2nd floor of the State Court Building or may be mailed to: Cobb County State Court Clerk – SEU payments, 12 East Park Square, Marietta, GA 30090. Payment slips must accompany payments that are sent in the mail. Cash, debit or credit cards (Mastercard and Visa) accepted if paying in person and the card holder must be present. Money orders or certified funds checks made payable to the Clerk of Cobb County State Court are also acceptable. Be sure to include your case number with all payments.

Your fine/restitution and fee are two separate accounts. You will need to note how much you are paying on each when you make the payments. It is also very important that you provide the case number so that the money is applied to the correct case.

Alcohol and Drug Testing

When you are told to submit to testing, you are to submit to a urine test. The test must check your urine for drugs and alcohol, unless otherwise specified by your Probation Officer. You must submit to a standard drug panel and ETG (test for alcohol use for up to 72 hours). The test also must be witnessed. The results shall be sent to your Probation Officer.

When you signed up for probation, you signed a Urine Abstinence Testing and Incidental Alcohol Exposure Form. This form will give you a list of things that you will need to avoid or limit your contact with while on probation. If you choose to use a different lab, the lab must still abide by these requirements. Some Judges require you to use the Cobb County Drug Treatment Lab for all testing, so be sure to check with your Probation Officer.

Do not consume excessive amounts of liquids before testing, for this will cause your sample to be diluted. Diluted tests = Failed tests.

In-Home Incarceration

In-home incarceration is in lieu of serving your jail time in the Cobb County Adult Detention Center.

More Information

At the time of sentencing or at the time of revocation of probation, the Judge will tell you where you can and cannot go. You will receive a form that has Addendum “A” Additional Conditions of Probation near the top. This form outlines in detail the requirements of your in-home incarceration. You are to give a copy of this form to the in-home incarceration monitoring company that you choose to use. Deviating from the requirement on this form will result in a warrant for your arrest and a revocation of your probation.

The in-home incarceration monitoring company that you choose must submit weekly updates to your Probation Officer. You are responsible for making sure the updates are sent to your Probation Officer. Failure to submit these updates will result in a warrant for your arrest and a revocation of your probation.

Abandonment

If you are under a suspended sentence for abandonment, it is your responsibility to provide to your Probation Officer proof that you are paying your child support. If you have not set up payments through a child support service then you will need to do so immediately. Failure to provide proof of your payment history will result in the revocation of your probation and jail time.
